The Service: WAF Cloud Solution

MeshPrivacy provides a WAF Cloud Solution (the "Service") designed to ensure interoperability between client applications and protected web resources.

The Service acts as an Interoperability Protocol Gateway, translating client requests into compatible formats required by third-party systems.

Authorized Use & Liability Shift

CRITICAL CLAUSE (Principal-Agent)

By using this Service, you affirm that you have the necessary authorization to access the target URLs. User warrants that they have a legitimate relationship with the target website (e.g., as a guest, customer, or account holder). User acts as the principal, and MeshPrivacy acts solely as your technical agent.

You acknowledge that you are solely responsible for the legality of your requests. MeshPrivacy provides the computational capability to generate compatibility tokens, but does not monitor or control the intent of your traffic.

Network Liability: Bring Your Own Proxy (BYOP)

The Service operates on a "Bring Your Own Proxy" (BYOP) model.

You acknowledge that all egress traffic to target websites originates from proxy IPs provided and controlled by YOU.

MeshPrivacy does not provide network infrastructure for egress traffic and assumes no liability for IP reputation, blocks, or network-level abuse complaints.

Remote Execution (No Reverse Engineering)

MeshPrivacy does not decompile, reverse engineer, or create derivative works of third-party scripts. All scripts are dynamically loaded from target origins and executed in a sandboxed remote execution environment at the User's direction. This constitutes script execution, not code analysis.

Human-in-the-Loop (HITL) Requirement

You agree that any interaction with visual challenges (e.g., hCaptcha, Arkose, reCAPTCHA) via the API must be utilized solely to facilitate accessibility for human users or for 'Human-in-the-Loop' QA testing. You warrant that you will NOT use the Service to fully automate challenge resolution using purely artificial intelligence in violation of third-party 'No AI' or 'No Bot' clauses.

Independent Data Copyright

User acknowledges that MeshPrivacy generates its own independent device telemetry and behavioral fingerprints based on public browser standards (e.g., W3C). We do not scrape, reuse, or misappropriate proprietary 'Threat Data' or 'Risk Scores' returned by third-party security vendors.

Abuse Prevention & Pacing

The Service utilizes 'Human-Pacing' technology to simulate realistic browsing patterns. Users agree NOT to override these defaults to generate high-velocity traffic that constitutes a 'Flooding' or 'Denial of Service' event against target infrastructure.

Privacy Shield

MeshPrivacy acts as a Privacy Firewall, normalizing device telemetry to exercise the User's right to privacy against invasive tracking. This aligns with GDPR Recital 30 (profiling rights).

You agree to use these features solely for the purpose of legitimate privacy protection and interoperability, and not for the purpose of evading bans associated with fraudulent activity.

Indemnification

You agree to indemnify, defend, and hold harmless MeshPrivacy, its operators, officers, directors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from your (or anyone using your account's) use of the Service, violation of these Terms, or violation of Third-Party Terms of Service(e.g., Akamai, Google, Cloudflare, DataDome, Kasada, Arkose Labs, hCaptcha, F5/Shape, Imperva). User acknowledges that MeshPrivacy has no control over User's target selection and acts solely as a data processing conduit.

Limitation of Liability

IN NO EVENT SHALL MESHPRIVACY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability shall not exceed the amount paid by you to MeshPrivacy in the twelve (12) months preceding the claim.

Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts.
